Privacy Policy

Who we are

Mabuhay Consul is an independent U.S. visa interview practice tool. We are not affiliated with, endorsed by, or connected to the U.S. government, the Department of State, or any embassy or consulate.

What we collect

Account details you provide (email address and, optionally, a display name); documents you choose to upload; the audio and transcript of your practice interviews; the scores and feedback we generate; and basic device and usage information needed to run the app.

Our legal basis for using your data

We rely on two bases. For the core service — running your practice interviews, grading your documents, and showing your history and scores — the basis is performance of our agreement with you (the Terms). For sensitive materials — the documents you upload and the audio recordings of your interviews — the basis is your explicit consent, which you give when you accept the Terms and again at the moment you upload a document or start a recorded interview. You can withdraw consent at any time by deleting the material or your account; withdrawal does not affect processing already carried out.

How we use your information

To run your practice interviews and grade your documents, to show your history and scores, to process purchases, and to keep the service reliable and secure. We do not sell your personal information or use your documents for advertising.

We do not train AI on your content

Your uploaded documents, your interview audio, and your transcripts are never used to train AI models — not ours and not our providers’. Document grading runs on Google’s Vertex AI and the spoken interview runs on Google’s paid Gemini API, both under terms that prohibit using your content to train their models. We use your content only to produce your own practice session and results.

Your documents

Documents you upload are used only to prepare and grade your own practice. You keep ownership of everything you upload; you grant us only a limited license to store and process it to provide your practice and results, and that license ends when you delete the material or your account. Your documents are tied to your account and are not shared with other users. Because this is a practice tool, you may black out sensitive numbers — bank account numbers, ID numbers, SSN, and TIN — before uploading; the grading relies on names, dates, and amounts, not these numbers. We encourage this as a way to share less with us.

Retention

We keep your information while your account is active or as needed to provide the service. When you delete your account, we permanently delete your profile, uploaded documents, interview history, and scores from our live storage and database. Because we keep the service reliable and secure, deleted data can persist briefly in operational systems before it is fully purged: operational logs are retained for about 30 days; encrypted database backups are retained for up to about 30 days; and point-in-time recovery covers roughly the prior 7 days. These systems are access-restricted and expire automatically. Some records, such as billing records, may be kept longer where required by law or to resolve disputes.

Who processes your data & where

We rely on trusted providers to operate the app: Google (Firebase authentication and storage; Vertex AI and the Gemini API for document analysis and the voice interview) and RevenueCat (purchase processing). These providers are based in the United States, so your information is processed and stored in the U.S. and other countries where they operate. We rely on their contractual safeguards for these international transfers, and they process your data only to provide these functions.

Security & breach notification

We protect your data in transit with encryption and restrict access to your account. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach that affects your personal information, we will notify you and the appropriate authorities without undue delay, as required by applicable law, including the Philippine Data Privacy Act.

Your rights

You can access, correct, or delete your information from within the app (Settings → Profile and Settings → Delete account). If you are in the Philippines, you also have rights under the Data Privacy Act of 2012, including the right to object, to access, to correct, and to lodge a complaint with the National Privacy Commission. Contact us to exercise any right.

Age

Mabuhay Consul is intended for people aged 18 and older. We do not knowingly collect information from children.

Changes

We may update this policy. When we do, we will revise the effective date above and, where appropriate, notify you in the app.

Terms of Service

Acceptance

By creating an account or using Mabuhay Consul, you confirm that you have read and agree to these Terms and our Privacy Policy, and that you understand this is an independent practice tool. If you do not agree, please do not use the app.

What the service is

Mabuhay Consul is a practice and coaching tool. It is not legal or immigration advice, and it is not affiliated with the U.S. government. Practice results are for preparation only and do not predict or guarantee any real visa decision.

Eligibility

You must be at least 18 years old to use the app.

Your account

Keep your login credentials secure. You are responsible for activity that happens under your account.

Purchases and credits

Prep Packs are one-time purchases that unlock document grading and interviews — there is no recurring subscription. Purchases are processed through your app store, subject to its terms. If a practice session fails or disconnects, the credit it used is automatically refunded to your balance.

Your content and the license you give us

You keep ownership of the documents and audio you provide. You grant us a limited, revocable license to store and process them solely to deliver your practice sessions, grading, and results. This license ends when you delete the content or your account. You are responsible for having the right to upload what you upload.

Consent to document and voice processing

Grading your documents and running your spoken interview require processing sensitive material — the documents you upload and audio recordings of your voice. By uploading a document or starting a recorded interview, you consent to this processing as described in our Privacy Policy. You can withdraw consent at any time by deleting the material or your account.

Acceptable use

Only upload documents you have the right to use. Do not misuse, disrupt, reverse engineer, or attempt to gain unauthorized access to the service.

AI limitations

Interviews, grades, and feedback are generated by AI and may be incomplete or inaccurate. Use your own judgment and consult official sources and qualified professionals for your real application.

Disclaimers

The service is provided “as is,” without warranties of any kind. We do not warrant that it will be error-free or that results will be accurate.

Limitation of liability

To the extent permitted by law, Mabuhay Consul is not liable for indirect, incidental, special, or consequential damages, or for any visa or immigration outcome. Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 50 (or its equivalent in Philippine pesos). These limits do not apply to liability that cannot be excluded by law, including gross negligence, willful misconduct, or your non-waivable rights as a consumer.

Termination

You may stop using the app and delete your account at any time. We may suspend or end access if these Terms are violated.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in California. Nothing here removes protections you have under the mandatory laws of your country of residence. If you are in the Philippines, you keep your rights under the Data Privacy Act of 2012 and applicable consumer-protection law.

General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the service. You may not assign your rights under these Terms; we may assign ours to a successor entity, for example when our operating company is formed. Our failure to enforce a provision is not a waiver of it.

Changes

We may update these Terms. Continued use after an update means you accept the revised Terms.

Delete your account & data

You can permanently delete your Mabuhay Consul account and all associated data at any time.

In the app: open Settings → Delete account, confirm your identity, and tap Delete my account.

This permanently removes: your profile, uploaded documents, interview history and transcripts, scores and feedback, and your credit balance. The deletion is immediate and cannot be undone.

If you can’t access the app, email support@mabuhayconsul.com from your account’s email address and we will delete your data on request. Records we are legally required to keep (e.g. billing records for tax/dispute purposes) may be retained as required by law.
